Brand notice. This service is offered publicly under the name MiaSure. "MiaSure" is a trade name of Nexture AI LLC, the Wyoming limited liability company that operates the Service and is your contracting party under this document. Any reference herein to "Nexture AI," "Nexture AI LLC," "the Company," "we," "us," or "our" means Nexture AI LLC operating as MiaSure.
Nexture AI LLC is committed to transparency. This page provides important summaries of key terms, warnings, and legal considerations regarding your use of the MiaSure platform and its services. These disclosures supplement, but do not replace, our full legal documents referenced below.
1. AI-Generated Content Disclaimers
Mia is an AI assistant. Mia, the assistant in the Service, is an artificial-intelligence system, not a person, and is not your insurance agent or broker. Deliverables generated with AI assistance are labeled as such.
Our platform leverages advanced Artificial Intelligence (AI) to provide tools such as document summaries, policy comparisons, and chatbot responses. It is crucial to understand the nature and limitations of these AI-generated outputs:
- Informational Purposes Only: All AI-generated outputs are provided for informational and assistive purposes only. They are designed to aid your workflow and research but are not intended to be comprehensive, definitive, or error-free.
- Not Professional Advice: The MiaSure platform and its AI tools do NOT provide legal, financial, tax, or professional insurance advice. You must consult with a qualified, licensed professional (e.g., an insurance broker, attorney, financial advisor) for specific advice tailored to your situation or your clients' needs.
- User Verification Required: AI models can sometimes "hallucinate," make errors, misinterpret information, or provide outdated details. You are solely responsible for thoroughly reviewing, verifying, and confirming the accuracy, completeness, and applicability of all AI-generated content before acting or relying on it, or before sharing it with any third party, including your clients.
- Not a Substitute for Human Judgment: Our AI tools are designed to augment, not replace, human expertise, professional judgment, and due diligence.
- The Policy Controls: The insurance policy documents, as issued by the insurer, control. Verify every output against them before relying on it.
These points are binding terms of our Terms of Service (Sections 2.3 through 2.7 and Section 6); this page summarizes them.
2. No Fiduciary Duty
Nexture AI explicitly states that it does not assume any fiduciary duty, broker-client relationship, or other professional obligations to you, your clients, or any third party. Your relationship with your clients, and your professional obligations to them, remain solely your responsibility.
3. User Responsibility for Legal & Regulatory Compliance
- For Insurance Brokers: If you are an insurance broker, agent, or firm, you are solely responsible for ensuring that your use of the MiaSure platform, including any AI-generated outputs, complies with all applicable federal, state, and local laws, regulations, and ethical standards governing your profession. This includes, but is not limited to, the Gramm-Leach-Bliley Act (GLBA) regarding Nonpublic Personal Information (NPI), state-specific insurance regulations (e.g., record-keeping requirements), and client consent for data processing.
- For All Users: You are responsible for ensuring that all content you upload to the platform is lawful and that you have all necessary rights and consents to do so. You are expressly prohibited from uploading Social Security Numbers (SSNs).
4. Data Processing & Third Parties
To provide our services, we use third-party service providers for functions like cloud hosting, Optical Character Recognition (OCR), Large Language Models (LLMs), AI voice and speech-to-text, and payment processing. We engage them under terms that require them to protect your data, and we do not authorize them to train their own models on it. Each provider, what it receives, and what its terms say about training and retention are listed on our Sub-processors page.
5. Your Data & Platform Improvement
We keep the corrections you make to extracted data as evaluation records, linked to the policy they belong to, to measure and improve the accuracy of the Service, and we compute aggregated, de-identified statistics across customers. We do not fine-tune or train any third-party AI model on your data. You can opt out of these uses, as detailed in Sections 4.2 and 6 of our Privacy Policy.
6. Regulatory Status
Nexture AI LLC is a technology company. We are not a licensed insurance producer, broker, agent, adjuster, or insurance company. We do not sell, solicit, or negotiate insurance. We do not provide insurance quotes, bind coverage, make any coverage determinations, or give opinions on whether coverage is adequate. Our platform is a software tool designed to assist licensed insurance professionals and their clients in managing and understanding insurance documents. This is a binding term of our Terms of Service (Section 2.5).
Availability. The Service is offered only in the United States and its territories, and access from sanctioned jurisdictions is blocked (Terms of Service Sections 1.2a and 1.2b).
7. Electronic Communications
By creating an account or using the Service, you consent to receive communications from Nexture AI electronically, including via email and in-app notifications. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing, in accordance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act).
8. Copyright & Intellectual Property Claims
Nexture AI respects the intellectual property rights of others. If you believe that any content on the Platform infringes your copyright, we maintain a Designated Copyright Agent and a formal notice-and-takedown, counter-notification, and repeat-infringer procedure under the Digital Millennium Copyright Act (DMCA). Please review our Copyright & DMCA Policy for the required contents of a notice and how to submit it.
9. Complaints & Disputes
If you have a complaint about our Service or believe we have not met our obligations, please contact us at [email protected]. We will acknowledge your complaint within five (5) business days and aim to resolve it within thirty (30) calendar days. If you are not satisfied with our response, please refer to the Dispute Resolution section in our Terms of Service.
